2. COLLECTION AND USE OF INFORMATION
a. Information Collected or Received from You (or Your Authorized Child).
Our primary goals in collecting information are to provide and improve our Services, to administer your (or your authorized child’s) use of the Services, and to enable you (or your authorized child) to enjoy and easily navigate our Services.
i. Account Information.
We need to collect and use certain Personal Data to provide the Services to you and fulfil the promises we make to you in the Terms of Service:
When you (or your authorized child) sign up for our Services you give us Personal Data voluntarily by providing it to us, for example when you sign up for an account (“Account”). We collect and use that information in order to authenticate you when you register an account and use the Services, to make sure you are eligible and able to receive the Services, and so that you receive the correct version of the Services.
We’ll collect certain information that can be used to identify or recognize you (or your authorized child) (“PII”), such as your name, email address, location, in-game username you choose to use on our Services, and internal account IDs that we assign to your account.
Registering an account will require you to assure that you (or your authorized child) are over 13 years old.
ii. Gameplay Information.
During game play we will collect certain information, such as your (or your authorized child’s) name and location. This information will not allow others to identify you (or your authorized child) unless you (or your authorized child) choose to use your (or your authorized child’s) real name and other identifying information.
We collect and use your device location information as you use our Services (and, if you elect to turn on background location tracking for our Services, while you are not directly interacting with the Services), including how you move around and events that occur during gameplay. Our Services include location based games whose core feature is to provide a gameplay experience tied to your real world location, so we need to know where you are to operate these games for you, and to plan the location of in-game resources (for example Games near Points of Interest). We identify your location using a variety of technologies, including GPS, the WiFi points you are accessing the Service through and mobile/cell tower triangulation.
We also collect and use your in-game actions and achievements, as well as certain information about your mobile device (including device identifiers, device OS, model, configuration, settings and information about third party applications or software installed on your device), to operate the Services for you and to ensure that we provide a fair gaming experience to all players in accordance with our Terms of Service (which includes anti-fraud and anti-cheating measures against behaviors prohibited under our Terms of Service).
We also use the information above to show in-game sponsored locations that are in your vicinity as part of the gameplay experience.
We further use the information above in order to provide technical and customer support to you.
You also give us Personal Data when you make a purchase through us, subscribe to our publications, register for a live event, enter a competition, promotion, sweepstakes or survey or communicate with us. Depending on which of these Services you use, that may include your name, mailing address, phone number, country of residency, date of birth (as needed to verify eligibility), and email address. We use that information to fulfil those Services to you and to provide related customer support to you.
In addition, we have and rely on a legitimate interest in using your Personal Data as follows:
· Using your IP address, browser type, operating system, the web page you were visiting before accessing our Services, the pages of our Services which you browsed or the features you used, and the time spent on those pages or features, the links on our Services that you click on, device identifiers, as well as actions you take during gameplay, your in-game user settings and preferences and your in-app purchases to understand who is using our Services and how.
· Using your contact information, namely your email address in order to communicate with you to provide technical and customer support.
· Using your internal account ID in order to attribute to your account any user content (such as local points of interest) that you elect to submit to City Check through the Services.
· Using your email address and device information in order to share updates and news about the Services with you either within the games or by email. You can unsubscribe from these at any time in your device setting or by sending a request to email@example.com .
· To provide social features within our games so you can interact and play with other players, including storing your communications with those players, find your friends and be found by them, and share your gameplay experience and achievements with your friends.
· To offer new or additional features for our Services.
· To carry out anti-fraud and anti-cheating measures and to ensure that you and other users are complying with our Terms of Service.
· To make legal or regulatory disclosures.
We will only use your Personal Data to do the following if we have your consent:
· If you elect to turn on background activity tracking in our Services, we will collect your Personal Data as you use the Services as well as in the background when you do not have the Services open on your device. This includes your device location. We use background activity tracking to provide you certain functionalities in the Services such as contextual alerts for nearby gameplay events. You can change your mind and turn off background activity tracking at any time in your device settings.
· If you elect to enable the Facebook User Friends permission available in some of our games (feature soon available), we will import from your linked Facebook account the list of your friends who also play the game and enabled Facebook User Friends. If you enable that permission, your Facebook profile picture and the name on your Facebook account will be visible to your friends in-game. You can change your mind and unfriend other players at any time from your in-app Friends settings. You can also revoke Facebook permissions for our games directly from your Facebook account settings.
· Send you marketing materials by email or via in-app notifications. You can unsubscribe from these at any time in your device settings or in-app settings.
iii. Accounts with Children.
By creating an account with City Check you are verifying that you are at least 13 year-old and that you are authorized to create and use this account or that you are the parent or legal guardian authorizing a child under 13 of using this account.
Parents have the right to refuse further collection, use, and/or disclosure of their child’s PII by notifying us. If we learn that we have received PII from a child under the age of 13 without the Parent providing consent, we will delete the child’s Account and all other PII collected in conjunction with such Account.
The Parents of children under the age of 13 understand and agree that City Check may provide information collected via the Services, to third parties who use such information for the sole purpose of administering or providing the Services (e.g., third party security monitoring services and web hosting companies).
b. Information Collected Using Cookies and other Web Technologies.
Like many website owners and operators, we use automated data collection tools such as Cookies and Web Beacons to collect certain information on our Site.
“Web Beacons” (also known as web bugs, pixel tags, or clear GIFs) are tiny graphics with a unique identifier that may be included on our Services for several purposes. For example, we may use Web Beacons to deliver or communicate with Cookies, to track and measure the performance of our Services, to monitor how many visitors view our Services, and to monitor the effectiveness of our advertising. Unlike Cookies, which are stored on the user’s hard drive, Web Beacons are typically embedded invisibly on web pages (or in an e-mail).
c. Information Related to Use of the Services.
Our servers automatically record certain information about how a person uses our Services (we refer to this information as “Log Data”), including both Account holders and non-Account holders (either, a “User”). Log Data may include information such as a User’s Internet Protocol (IP) address, user agent, browser type, operating system, the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, search terms, the links on our Services that a User clicked on, and other statistics. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize, and enhance our Services by expanding their features and functionality and tailoring them to our Users’ needs and preferences. We may use a person’s Log Data and other information to generate aggregate, non-identifying information about how our Services are used and use such aggregated information to understand and improve our Services and to administer use of the Services. If we engage a third party to analyze the Log Data, we will ensure that such third party is bound by contractual terms requiring it to process such Log Data in accordance with relevant European data protection laws (including, without limitation, the Data Protection Directive).
d. Device Information.
We collect certain information about your (or your authorized child’s) mobile device when you (or your authorized child) use our Services, like a device identifier, user settings, the operating system of your (or your authorized child’s) device, information about other applications installed on your (or your authorized child’s) device as well as information about your use of our Services while using the mobile device. We may use this information to provide the Services and to improve and personalize our Services for you (or your authorized child).
e. Location Information.
The App is a location based game. We collect and store information about your (or your authorized child’s) location when you (or your authorized child) use our App and take game actions that use the location services made available through your (or your authorized child’s) device’s mobile operating system, which makes use of cell/mobile tower triangulation, wifi triangulation, and/or GPS. You understand and agree that by using our App you (or your authorized child) will be transmitting your (or your authorized child’s) device location to us and some of that location information, along with your (or your authorized child’s) name, may be shared through the App. For example, when you take certain actions during gameplay, your (or your authorized child’s) user name and location may be shared through the App with other users who are playing the game. We may also use location information to improve and personalize our Services for you (or your authorized child).
3. INFORMATION THAT WE SHARE WITH THIRD PARTIES
We will not share any of your (or your authorized child’s) PII that we have collected from or regarding you (or your authorized child) except as described below:
a. Information Shared to fix bugs and correct errors.
b. Information Shared with Our Services Providers.
We may engage third party service providers to work with us to administer and provide the Services. These third party service providers have access to your (or your authorized child’s) PII only for the purpose of performing services on our behalf and are expressly obligated to secure your (or your authorized child’s) PII and not to disclose or use your (or your authorized child’s) PII for any other purpose.
c. Information Shared with Third Parties.
We may share aggregated information and non-identifying information with third parties for research and analysis, demographic profiling, and other similar purposes. This information will not include your (or your authorized child’s) PII.
d. Information Disclosed in Connection with Business Transactions.
Information that we collect from our users, including PII, is considered to be a business asset. Thus, if we are acquired by a third party as a result of a transaction such as a merger, acquisition, or asset sale or if our assets are acquired by a third party in the event we go out of business or enter bankruptcy, some or all of our assets, including your (or your authorized child’s) PII, may be disclosed or transferred to a third party acquirer in connection with the transaction. In the event of such a transaction, we will give you notice of the transaction and the opportunity for a period of 30 days to refuse disclosure or transfer of your (or your authorized child’s) PII to the third party acquirer in connection with the transaction.
e. Information Disclosed for Our Protection and the Protection of Others.
We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you (or your authorized child) that is in our possession or control to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (a) to respond to claims, legal process (including subpoenas); (b) to protect our property, rights, and safety and the property, rights, and safety of a third party or the public in general; and (c) to identify and stop any activity that we consider illegal, unethical, or legally actionable activity.
4. YOUR CHOICES
We offer you choices regarding the collection, use, and sharing of your (or your authorized child’s) PII and we’ll respect the choices you make. Please note that if you decide not to provide us with the PII that we request, you (or your authorized child) may not be able to access some or all of the features of the Services.
a. Rescinding Your Consent.
You have the right to refuse further collection, use, and/or disclosure of your (or your authorized child’s) PII by notifying us. If you have consented to your (or your authorized child’s) access to and use of the Services but wish to rescind such consent, please contact us at firstname.lastname@example.org to submit the request. We will promptly discontinue your (or your authorized child’s) access to and use of the Services and ensure that your (or your authorized child’s) PII is no longer publicly accessible through the Services. Please note, however, that if you refuse further collection, use, and/or disclosure of your (or your authorized child’s) PII, you may not be able to access and use all or a portion of the Services.
c. Accessing, Modifying, and Deleting Your Information.
Parents may request and obtain access to PII stored about their children who are under the age of 13 by contacting us at email@example.com. If you want us to modify or delete your (or your authorized child’s) PII and/or your (or your authorized child’s) Account, or discontinue the provision of your (or your authorized child’s) PII to third parties, please contact us at firstname.lastname@example.org with your request. We’ll take steps to modify or delete your (or your authorized child’s) information as soon we can (unless otherwise permitted by applicable law). Please note, however, that some information may remain in archived/backup copies for our records or as otherwise required by law.
5. KEEPING YOUR INFORMATION
Following termination or deactivation of your (or your authorized child’s) Account, City Check, its clients, affiliates, or service providers may retain information (including your (or your authorized child’s) profile information) and user content for a commercially reasonable time period for backup, archival, and/or audit purposes. If you have any questions about termination or deactivation of your (or your authorized child’s) Account, please contact us directly at email@example.com.
6. RESPONDING TO DO NOT TRACK SIGNALS
Our Services do not have the capability to respond to “Do Not Track” signals received from various web browsers.
7. THE SECURITY OF YOUR INFORMATION
We take appropriate administrative, physical, and electronic measures designed to protect the information that we collect from or about you (or your authorized child) from accidental or unlawful destruction, accidental loss or unauthorized access, use, modification, interference, or disclosure. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.
